The Barolo Grill constructed a raised dining area with no ramp or lift for persons who use wheelchairs. Later in court, they admitted that the alterations were not accessible, no steps were taken to improve the path of travel, and no steps were taken to remove barriers where removal was readily achievable.

They are now required to pay $10,000 in civil penalities, $6000 in damages to four individuals, and install a ramp to the new raised dining area. They also agreed to host an ADA information seminar to inform other restaurants in Colorado about their responsibilities under the law.
